Definitions
- Account means a website portal account and/or a linked game account You create to access the Service.
- Country refers to: United States. Game and related infrastructure are hosted in North America East (NA East), United States.
- Device means any device that can access the Service.
- Digital Goods means optional virtual currency, cosmetic items, convenience items, or other in-game or store entitlements offered through the Service.
- Orders mean a request by You to purchase Digital Goods or make a donation through the Service.
- Provider(also "We", "Us", or "Our") refers to Kafra Corporation.
- Service means the Website, game server, account portal, databases, support tools, donation or cash-shop features, and related community services we operate.
- Website refers to Kafra Corporation, accessible from https://kafracorporation.com.
- You means the individual accessing or using the Service.
2. Acknowledgment
These Terms govern use of the Service and form an agreement between You and the Provider. They apply to all visitors and users.
Your access is also conditioned on acceptance of our Privacy Policy and community Rates & Rules, which are incorporated by reference.
You represent that You are at least 13 years of age. If You are under the age of majority in Your jurisdiction, You may use the Service only with permission from a parent or legal guardian who agrees to these Terms. We do not knowingly permit use by children under 13.
3. Fan-made project and intellectual property
Kafra Corporation is a free, non-commercial, fan-made project built on open-source software and community effort. It is not affiliated with, sponsored by, or endorsed by Gravity Co., Ltd., Gravity Interactive, Inc., or any related rights holders.
Trademarks, characters, artwork, and other intellectual property related to the underlying game remain the property of their respective owners. Our original code, website content, custom systems, and branding for Kafra Corporation are owned by the Provider or its licensors.
You may not scrape, redistribute, or commercially exploit our Website content, databases, or custom assets except as expressly allowed by Us or by applicable open-source licenses.
4. The Service
We provide access to a multiplayer game server and related web tools for entertainment. Features, rates, balance, maps, items, and availability may change at any time.
The Service is provided for personal, non-commercial entertainment use. We may modify, suspend, or discontinue any part of the Service (including permanent shutdown) with or without notice.
5. User Accounts
When You create an Account, You must provide information that is accurate, complete, and current. You are responsible for safeguarding Your passwords and for all activity under Your Accounts.
You agree not to share Account credentials, sell or transfer Accounts, or use another person's Account without permission. Notify Us promptly if You suspect unauthorized access.
You may not use a username that impersonates others, infringes rights, or is offensive, vulgar, or obscene. We may require a username change or reclaim names that violate these Terms.
Support staff will never ask for Your password. Account recovery uses verified email and other security checks We provide.
6. Acceptable use and game rules
You agree not to:
- Use bots, macros, packet editors, or other unauthorized automation or third-party tools that interact with the game client or server
- Exploit bugs or unintended mechanics for gain; report them to staff instead
- Engage in real-money trading of Accounts, items, or currency outside any Official donation or cash-shop channel we authorize
- Harass, threaten, scam, use hate speech, or otherwise abuse other players or staff
- Attempt to disrupt, reverse engineer, attack, or gain unauthorized access to the Service or other users' data
- Use the Service for any unlawful purpose or in violation of these Terms or the Rates & Rules
We may investigate suspected violations and take action We consider appropriate, including warnings, item/zeny removal, temporary suspension, or permanent bans, with or without prior notice.
7. Donations, Orders, and Digital Goods
Playing the Service does not require payment. Optional donations or purchases of Digital Goods may be offered to support hosting and development. Availability of a cash shop or donation packages may change.
7.1 Orders
By placing an Order, You represent that You are legally able to enter into a binding contract and that payment information You provide to our payment processor is accurate and authorized.
Payments are processed by third-party processors. We do not store full payment card numbers. Orders may be refused or cancelled for suspected fraud, errors, or other legitimate reasons.
7.2 No real-world value
Digital Goods, virtual currency, characters, and items have no real-world monetary value. They are licensed to You solely for use within the Service and are not Your property. You may not redeem them for cash or transfer them except as the Service allows in-game.
7.3 Refunds
Because Digital Goods are delivered electronically and can be used immediately, all sales are generally final once delivered, except where required by law or where We choose to issue a goodwill refund. Chargebacks or payment disputes initiated in bad faith may result in Account suspension and recovery of delivered Digital Goods.
7.4 Pricing and availability
We may change prices, packages, and availability at any time. We do not guarantee that descriptions or store listings are error-free and may correct errors without liability.
7.5 Receipts
Each completed purchase creates a receipt in Your dashboard (Orders) and is emailed to the address on Your Account. We keep a matching staff copy. Purchases of Cash Points are digital goods used in the Service and are not tax-deductible donations.
8. Links to other websites
The Service may contain links to third-party websites or services We do not control. We are not responsible for their content, policies, or practices. Access them at Your own risk.
9. Termination
We may suspend or terminate Your Account immediately, without prior notice or liability, for any reason, including if You breach these Terms or the Rates & Rules.
Upon termination, Your right to use the Service ends. You may stop using the Service at any time. Sections that by their nature should survive (including ownership, disclaimer, limitation of liability, and governing law) will survive termination.
We are not obligated to compensate You for lost progress, items, or Digital Goods if the Service or Your Account ends, except where required by applicable law.
10. Limitation of Liability
To the maximum extent permitted by law, the entire liability of the Provider and its suppliers under these Terms, and Your exclusive remedy, is limited to the amount You actually paid to Us through the Service in the twelve (12) months before the claim, or 100 USD if You have not paid anything.
To the maximum extent permitted by law, We are not liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, goodwill, or business interruption, arising from Your use of or inability to use the Service, even if We were advised of the possibility of such damages.
Some jurisdictions do not allow certain limitations; in those places, Our liability is limited to the greatest extent permitted by law.
11. "AS IS" and "AS AVAILABLE" Disclaimer
The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, whether express, implied, or statutory, including merchantability, fitness for a particular purpose, title, and non-infringement.
We do not warrant that the Service will be uninterrupted, secure, or error-free; that defects will be corrected; or that the Service or servers are free of harmful components. Game balance, rates, and content may change. Data loss, rollbacks, and downtime can occur.
12. Governing Law
These Terms are governed by the laws of the United States, without regard to conflict-of-law rules. Your use of the Service may also be subject to other local, state, national, or international laws.
Because our infrastructure is hosted in North America East (NA East), United States, You agree that disputes will be handled in courts located in the United States to the extent permitted by law, after first attempting informal resolution as described below.
13. Dispute resolution
If You have a concern or dispute about the Service, You agree to first contact Us and attempt to resolve it informally. Many issues can be handled through support tickets or email.
14. For European Union (EU) users
If You are an EU consumer, You may benefit from mandatory provisions of the law of the country where You reside. Nothing in these Terms limits those non-waivable rights.
15. United States legal compliance
You represent and warrant that (i) You are not located in a country subject to a United States government embargo or designated as a "terrorist supporting" country, and (ii) You are not listed on any United States government list of prohibited or restricted parties.
16. Severability and Waiver
Severability
If any provision of these Terms is held unenforceable, it will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will continue in effect.
Waiver
Failure to enforce a right or provision of these Terms is not a waiver of that right or of any later breach.
17. Translation
If these Terms are translated, the English version controls in the event of a conflict.
18. Changes to these Terms
We may modify these Terms at any time. For material changes, We will make reasonable efforts to provide notice (for example by posting on the Website) before they take effect. The "Last updated" date will be revised when We post changes.
By continuing to use the Service after changes become effective, You agree to the revised Terms. If You do not agree, stop using the Service.
